Gaming machine permit


Pubs and some other licensed premises have an automatic entitlement to two gaming machines, subject to a notification procedure under the Gambling Act 2005. If you wish to offer more than two machines you must first get a licence from us.

You will need to make a notification application to us that will give notice of your intention to make either one or two Category C or D gaming machines available on your premises.

This automatic entitlement will last for an unlimited duration as it is linked to the premises licence granted under the Licensing Act 2003.

Premises requiring more than two gaming machines

If you wish to offer more than two gaming machines, will need to apply to us for an alcohol licensed premises gaming machine permit.

The alcohol licensed premises gaming machine permit will last for an unlimited duration.  

All holders are required to pay a £50 annual fee. 

What you must do

If you have an existing Section 34 permit under the Gaming Act 1968, you should write to us prior to its expiry notifying us of your intention to make one or two Category C or D gaming machines available on the premises, in accordance with the automatic entitlement.

If you wish to give us notice of your intention to make up to two Category C or D gaming machines available you should complete the appropriate form and submit it. 

If you wish to make more than two machines available you must complete the application for an alcohol licensed premises gaming machine permit.

Both applications should be accompanied by the relevant fee.

Permit holders have to comply with the Gambling Commission gaming machine permits codes of practice.

If you fail to comply with the codes of practice you could have your permit revoked.

What we must do

We are required to issue you with an acknowledgement of receipt of your notification of up to two machines.

We are required to issue you with a permit under the new act authorising the number of machines you are currently entitled to and then consider your application if a request for more machines has been made. 

What happens next

In determining an application we must have regard to the licensing objectives and to the guidance issued by the Gambling Commission. We may also take into account any other matters which are considered relevant to the application.

We may either grant or refuse an application. In granting the application we may alter the number and category of gaming machines authorised by the permit. If we grant the application, we must issue the permit as soon as possible after that. Where we refuse the application we must notify the applicant as soon as possible, setting out the reasons for refusal.

Your right to appeal 

We must not refuse an application, or grant it for a different number or category of machines, unless we have notified the applicant of our intention to do so and given the applicant an opportunity to make representations (orally or in writing or both).
